— Joe Biden and the border

The Federal Government is in violation of its own laws governing the Border

Imagine a Government with Laws

We have a government that is in charge that doesn’t follow the laws. They don’t follow the laws approved and passed by congress, they do not follow the Constitution and the agencies that are supposed to be here to protect us don’t do anything to the violators.

President Biden could fix the border problem with a pen, just as former President Trump did but he has no inclination to do so. Mayorkis who is in charge of securing the border is also not doing his job. Congress is in the process of Articles of Impeachment against Mayorkis but even if passed by Congress is just a political move because there isn’t a two-thirds majority in the Senate to convict him.

The fight over border security in Texas is also a problem for the Federal government. The Supreme Court only ruled that razor wire on Federal land could be cut, but the Border patrol isn’t interested in doing so. In addition the Supreme Court did not say Texas could not put up more razor wire. The game the Biden Administration is playing is that Federal Law trumps State Law, however States have the authority to protect themselves by rights given under the Constitution. Article VI Paragraph II of the United States Constitution (The Supremacy Clause) does not apply here and that is why the Supreme Court ruled the way it did. In addition the Federal government was ordered to supply land deeds to prove there interests were being violated which they have failed to do so. Governor Abbot of Texas is doing the right thing and the Border patrol is aligned with the Texas National Guard. On Feb 1, Governor DeSantis out of Florida is sending his national guard troops to assist Texas.

So What are the Laws that are in Effect?

The primary law governing immigration is the Immigration and Nationality Act (INA), also known as the Immigration Act of 1965. This act establishes the legal framework for various aspects of immigration, including:

  • Admissibility: Who is allowed to enter the United States and who is not (grounds of inadmissibility include criminal convictions, national security concerns, health issues, etc.).
  • Deportation: The process for removing individuals who are in the United States illegally.
  • Citizenship: The process of acquiring U.S. citizenship.
  • Visas: Different types of visas for temporary and permanent residency, work, study, and other purposes.
  • Refugees: The process for granting asylum and refugee status to individuals fleeing persecution.

In addition to the INA these laws were also voted for and passed by Congress and also are in effect.

  • The Refugee Act of 1980: Establishes the legal definition of a refugee and sets the guidelines for granting asylum.
  • The Immigration Reform and Control Act of 1986: Imposed employer sanctions for knowingly hiring unauthorized workers.
  • The Personal Responsibility and Work Opportunity Reconciliation Act of 1996: Introduced welfare reform measures with implications for immigration.
  • The Homeland Security Act of 2002: Created the Department of Homeland Security, which oversees immigration enforcement.
  • The Deferred Action for Childhood Arrivals (DACA) program: Offers temporary protection from deportation and work authorization to certain undocumented immigrants who came to the U.S. as children. (DACA’s legal status is currently in flux due to court challenges.)

Here are some resources for you if you would like to research

If you spend your own time researching immigration law, you will arrive at the same conclusion as our legal scholars. The conclusion is That Joe Biden and Mayorkis are in violation of Federal Law for failing to enforce the border which should result in Impeachment. If found guilty then it would be up to the Congress and Senate to hold them accountable.

My Concern as a United States Citizen

The unsecured border has put every American at risk. There has been unchecked immigration that has allowed Terrorist Cells into the country. Drug Cartels have been in control of the border and there is an influx of Fentanyl that is taking American lives. Besides the drugs, child sex trafficking has occurred. Hardened criminals are crossing into the United States bringing major crime to our country.

Cities are being overwhelmed by illegal immigration. Cities are to the breaking point on funding and facilities. Can you blame Texas from securing their own border?

What is your take? Can you defend Joe Bidens inaction as President and if you think you can, comment on my blog below. After reading the laws and researching this situation on your own I challenge you to do so.

I ask every American to contact their Congressperson and Senator and ask them to enact laws that would hold the President of the United States accountable for securing the border. I also ask for a special Amendment that would allow prosecution of the President of the United States for failure to do so.

You can vote this fall to make a change, but are you willing to do so? Biden has to go and so does Harris. There is no question about that, but I am not enthusiastic about another 4 years with former President Trump. Like many Americans I would like new choices but this may be all we are left with.

Days continue to go by as the President does nothing to secure the border. Calls from his own party go unanswered. Texas has gone to great lengths to solve its problem so it has moved to California and Arizona. Gavin Newsom will do absolutely nothing in California, as he is going to squeeze taxpayers to fund his free welfare for all – legal or not. Being a California resident I am deeply concerned. Another 10 months – and possibly 5 years of inaction depending on the election? We are in serious doo doo

I am glad the Senate Deal on the border / Ukraine / Israel is dead. The bill should have not been tied to other spending – the 5000 a day illegal crossing for 7 days in a row – to trigger the border close was nonsense, and the rule that anyone can claim asylum was ridiculous. The failure to impeach the Homeland Security director was a loss – but it would have never been approved in the senate – but the guy deserves it. Biden is toast – he forgot who Hamas was today in his rambling words to the press. I am so embarrassed as an American that Biden is our President
